Privacy Policy

Effective October 24, 2026.

This policy explains how Realty Montgomery collects, uses, and shares information through realtymontgomery.com.

Information you submit

When you submit an inquiry form, we collect the information you provide: name, email, phone, price range, purchase timeframe, community or property of interest, whether you are working with an agent, the type of help requested, any comments, and your contact consent.

Information collected automatically

With each inquiry we also record the page you submitted from, the page you first arrived on, the referring website without its query parameters, the time of your first visit, and non-identifying campaign details such as UTM campaign tags. Advertising click identifiers (Google's gclid, gbraid, or wbraid, or Facebook's fbclid) are collected and retained only when advertising measurement is enabled and you have given the required advertising permission, without an applicable opt-out. They are removed from session attribution and the current web address when measurement is blocked or withdrawn. Visit information is kept in your browser session until you submit a form.

How we use and store your information

We use this information to respond to your inquiry, follow up about your home search by phone, text, or email with your consent, and understand which pages and campaigns lead to inquiries. Inquiries are stored in a secured database that is not publicly accessible and can be reviewed only by Realty Montgomery. When an inquiry is saved, an email notification with your contact details, home preferences, and inquiry source is sent to Realty Montgomery's business inbox through our email delivery provider.

We do not currently use a third-party customer relationship management system. If we add one, we will update this policy.

Data Retention

Our retention schedule calls for ordinary buyer inquiries that do not become required brokerage or transaction records to be retained for 24 months after the last substantive two-way communication, or after submission if there is no later communication. Attribution saved with an inquiry is generally retained for 12 months after submission. Required transaction and brokerage records are treated separately: applicable Texas broker rules require covered records to be kept for at least four years from closing, termination of the contract, or the end of a real estate transaction, using the applicable trigger. Other legal duties, complaints, disputes or preservation requirements may require longer retention.

Advertising-consent evidence is generally retained for four years after the later of the last advertising processing relying on it or the latest choice or withdrawal. We preserve earlier acceptance and later withdrawal during that period and retain the minimum current refusal needed to honor an opt-out. We do not remove a refusal in a way that makes an earlier acceptance effective again. Conversion-deduplication records remain for the lifetime of the corresponding saved inquiry. Minimal privacy-request and fulfillment records are generally retained for three years after completion or appeal closure, whichever is later, subject to any longer preservation duty.

Review and deletion are manual, not automatic. We review records quarterly and remove eligible information from active records and unnecessary notification emails, subject to applicable recordkeeping and preservation requirements. Records may remain until the next manual review. Notification emails are separate copies in our business inbox and provider systems. Where supported, we request removal of eligible provider-held copies and document unresolved limits; deletion from our database or inbox does not establish deletion from provider systems, archives or backups. We cannot promise immediate or selective erasure from those systems. Residual copies are handled under applicable law and the provider's available arrangements. Information already received by Google is subject to Google's own retention practices and applicable privacy rights; our browser controls cannot erase it.

Attribution kept only in browser session storage ordinarily lasts for the browser page session, which can survive a page reload or a restored session. Advertising preferences kept in browser local storage have no configured expiry and remain until replaced or cleared. Blocking or withdrawing advertising permission clears accessible advertising click identifiers from session attribution and the current web address; it does not automatically delete an existing inquiry or historical consent evidence. Private consent history preserves earlier acceptance alongside later withdrawal.

Google Ads conversion measurement

Consent-based Google Ads conversion measurement is available to understand visits to our website from advertising and which visits lead to a successful buyer inquiry. The Google tag loads only with saved affirmative advertising permission and in an eligible region, without an applicable opt-out. Without that permission, measurement remains blocked. When it loads, Google receives:

Google may place or read advertising cookies (such as _gcl_au) on your browser to connect an ad click with a later inquiry. Google processes this information under its own privacy policy, available at policies.google.com/privacy.

We do not currently use Google remarketing or ad personalization, and we do not use Google enhanced conversions. We do not intentionally send your name, email address, phone number, or the contents of your inquiry to Google for conversion measurement. The conversion notice does not include our internal inquiry record number.

We do not load the Google tag for visitors in the European Economic Area, the United Kingdom, or Switzerland, or when we cannot determine a visitor's region.

Our controls require an optional affirmative advertising choice from visitors in every region, in addition to those geographic restrictions. Acceptance and refusal are equally available. We privately record a random browser identifier, your choice, its date and time, the region result, and the version of the notice describing cookies, data, Google, and the measurement purpose. Each eligible inquiry refers to that record; prior acceptance evidence is preserved when permission is withdrawn. We do not replay inquiries that were blocked when submitted.

Your choices

You can turn off advertising measurement on this browser at any time with the control below. We also honor the Global Privacy Control signal and Do Not Track browser settings as an opt-out. You can also block or delete cookies in your browser settings. Our inquiry forms work normally whether or not advertising measurement is on.

Withdrawal stops subsequent measurement, removes accessible advertising cookies, clears click identifiers, and synchronizes the refusal across open tabs on this website where browser storage is available. A page that has already loaded the Google tag reloads to clear its running code. Requests already sent or in flight cannot be recalled, and we cannot delete Google's third-party cookies or information already received by Google. Choices are browser-specific; blocking browser storage may limit synchronization, in which case measurement remains blocked. Inquiry saving and email notifications do not depend on Google being available.

We do not sell your personal information for money. You may opt out of communications from us at any time by replying STOP to texts, asking us in a reply email, or contacting us directly. Depending on where you live, you may have the right to request access to, correction of, or deletion of your personal information, or to opt out of certain advertising uses. Contact us to make a request.

To request access to, correction of, or deletion of your information, contact our primary privacy request contact, Stephen G. Pivach, at SPivach@PivachProperties.com, or call 713-817-9709. Describe the request and provide enough information for us to locate your inquiry, such as the email address used to submit it. Please do not send passwords or sensitive identity documents in your initial request. We may need proportionate identity verification before providing or changing personal information, to protect it from unauthorized requests. No website account is required.

We log requests privately, review applicable rights and exceptions, and document the response and actions taken. Our manual procedure targets acknowledgement within five business days and a response within 45 calendar days, subject to any different applicable legal deadline. Where applicable law permits a necessary extension, we give notice and reasons within the original response period; our Texas procedure permits one additional 45-day period when reasonably necessary. Deletion may be limited by legal recordkeeping, dispute-preservation or other applicable exceptions; withdrawing advertising permission is separate from requesting deletion. We explain any denial or partial response and unresolved provider or backup limits.

You can appeal a denied request using the same contact details. Our appeal response target is 60 calendar days, subject to applicable law. Where required, our response includes information about submitting a complaint to the Texas Attorney General. We handle requests according to applicable law, including any requirements for authorized agents, free responses, verification and exceptions.
